Pro Booker Terms

These terms apply to anyone approved as a Pro Booker on Gigster, operated by Gigster Online (Pty) Ltd (“Gigster”). They apply alongside Gigster's general Terms of Use; where the two differ on the Pro Booker programme, these terms apply.

1. The programme

A Pro Booker is an event-industry professional who introduces clients to talent and suppliers (“vendors”) on Gigster, and earns a referral fee when a booking they introduced is confirmed and completed through Gigster.

2. Eligibility and approval

  1. You apply at thegigster.com/become-a-pro-booker with your business or trading name, website, LinkedIn profile and one to three industry references. Sole proprietors are welcome.
  2. Gigster may ask for further proof of identity and business registration, and may contact your references.
  3. Approval is at Gigster’s discretion and may be suspended or withdrawn as set out in section 10.

3. How a referral is credited to you

  1. A booking is your referral only when you submit the enquiry from your Pro Booker account, on behalf of your client.
  2. The link is made when the enquiry is created. It cannot be added later, and never after the client has accepted a quote.
  3. Each booking has one Pro Booker.
  4. You confirm that your client has agreed to you making the enquiry for them, and that the details you give are accurate.

4. The referral fee

  1. The fee is 10% of the vendor’s quoted fee, excluding VAT (where the vendor charges VAT).
  2. It is added to the client’s total. It is never deducted from the vendor’s fee.
  3. The fee forms part of the single total the client pays, and is not shown to the client as a separate line.
  4. The fee is fixed when the client accepts the quote and does not change afterwards. Gigster may change the rate for future bookings on notice to you.

5. Payment to you

  1. Your fee becomes payable once the client has paid the booking in full and the dispute window (48 hours after the event) has closed with no dispute raised.
  2. It is paid by EFT with Gigster’s regular vendor payouts, on the same timing as balance payouts to Gigster Pro vendors, into a South African bank account in your or your business’s name.
  3. Gigster pays your fee only from money it has actually received from the client. If the client does not pay in full for any reason, no fee is due, and Gigster has no obligation to pay it, to recover it from the client, or to compensate you. If the client pays later, the fee becomes payable then.
  4. There is no minimum payout.

6. Cancellations, refunds and disputes

  1. If a booking is cancelled before the event, no referral fee is payable.
  2. If a client raises a dispute, your fee is held until it is resolved.
  3. If the client is refunded in full or in part, your fee is reduced in proportion. Where it has already been paid, Gigster may deduct the difference from your future fees.

7. Client money

  1. Clients pay Gigster directly, by card or EFT. You may never take payment from a client for a booking made through Gigster.
  2. You are never asked to fund a deposit, guarantee a payment, or carry the cost of a vendor’s or client’s default.

8. Tax

  1. You are responsible for your own income tax.
  2. The referral fee is inclusive of any VAT. If you are VAT-registered, you account for VAT out of the fee and provide Gigster with a valid tax invoice; Gigster does not pay VAT in addition to it.

9. Conduct

  1. Keep bookings on Gigster. For 12 months after you introduce a client to a vendor through Gigster, any booking between them that you arrange or take part in must be made through Gigster.
  2. No working around the platform. You may not approach a vendor you found through Gigster to arrange work for your clients outside Gigster.
  3. No contact details in messages. Phone numbers, email addresses and links are blocked in messages for everyone. Contact details are shared once a booking is confirmed.
  4. Conflicts of interest. You must tell Gigster if you are a vendor, manage or represent a vendor (for example as their manager or agent on Gigster), or have a financial interest in one. You cannot earn a referral fee on a booking with yourself or with a vendor you manage, represent or have an interest in. Your own services belong on a vendor listing, and the acts you manage on a manager account.
  5. Represent Gigster accurately. You may describe yourself as a Gigster Pro Booker, but not as an employee or agent of Gigster, and you may not otherwise use Gigster's name or logo without written permission.
  6. Personal information. Handle client and vendor personal information in line with the Protection of Personal Information Act (POPIA), and only for the booking it was shared for.

10. Suspension and termination

  1. You may end your Pro Booker status at any time by telling Gigster in writing. Gigster may end it on 14 days’ written notice.
  2. Gigster may suspend or end it with immediate effect if you materially breach these terms, for example by taking bookings off the platform, misrepresenting yourself, or acting fraudulently.
  3. Ending your status does not affect fees you have already earned. The fee on a booking confirmed before the end date is paid under section 5, provided the event takes place and the client pays in full.
  4. Gigster may withhold a fee only where it relates to a booking directly affected by your breach, and only to the extent of the loss Gigster or a vendor suffered because of it. Gigster will tell you in writing why, and give you 5 business days to respond before making a final decision.
  5. Gigster may set off any amount you owe it against fees due to you.

11. Liability

  1. Gigster facilitates bookings and payments and is not responsible for how a vendor or client performs.
  2. Gigster’s liability to you is limited to the referral fees owed to you under these terms.
  3. Nothing in these terms limits liability for fraud, gross negligence or wilful misconduct.

12. Changes and law

  1. Gigster may update these terms and will give you notice of any change that affects you.
  2. These terms are governed by the laws of South Africa.
